3. User Accounts and Eligibility
3.1 Account Requirements
- You must be at least 18 years old to use this Service
- You must provide accurate and complete registration information
- You are responsible for maintaining the security of your account credentials

- Government agencies must provide appropriate authorization documentation
3.2 Account Types

4. Auction Participation
4.1 Bidding Rules
- All bids are legally binding offers to purchase
- Bids cannot be retracted once submitted and confirmed
- The highest valid bid at auction close wins the item

- Real-time bid validation prevents invalid or duplicate bids
4.2 Payment Obligations
- Winning bidders must complete payment within specified timeframes
- Payment processing is handled securely through Stripe
- Buyer's premiums and applicable taxes are clearly disclosed
- Refunds are processed through cashier-managed workflows
- Failed payments may result in account restrictions
4.3 Item Condition and Descriptions
- All items are sold "as-is" unless otherwise specified
- Condition reports and descriptions are provided in good faith
- Physical inspection periods may be available before auctions
- Digital images and descriptions are for reference only
- Authentication and provenance information is provided when available
5. Platform Usage Guidelines
5.1 Acceptable Use
You agree to use the platform only for legitimate auction-related activities and not to:
- Manipulate auctions through false bidding or collusion
- Interfere with the platform's operation or security features
- Attempt to circumvent payment processing systems
- Use automated tools to gain unfair bidding advantages
- Share account credentials or allow unauthorized access
- Upload malicious content or attempt system intrusions

- Maintain professional conduct in all platform interactions
- Comply with applicable laws and regulations
- Respect intellectual property rights
- Provide accurate information in all submissions
- Report suspicious activities or security concerns promptly
6. Payment Terms and Conditions
6.1 Payment Processing
- All payments are processed securely through Stripe
- PCI DSS Level 1 compliance ensures payment security
- Multiple payment methods are supported for convenience
- Transaction fees may apply as disclosed at time of payment
- Currency conversion rates are determined by payment processors
6.2 Refunds and Disputes
- Refunds are managed through our cashier-controlled system
- Dispute resolution follows established auction house procedures
- Chargeback protections are in place for legitimate transactions
- Refund processing timeframes depend on payment method
- Documentation may be required for dispute resolution
7. Intellectual Property Rights
7.1 Platform Ownership
Auction Pro owns all rights, title, and interest in the platform, including software, designs, trademarks, and proprietary algorithms. Users are granted a limited, non-exclusive license to use the platform for its intended purposes.
7.2 User Content
- Users retain ownership of content they upload to the platform
- Users grant Auction Pro necessary licenses to display and process content
- Users are responsible for ensuring they have rights to uploaded content
- Copyright infringement reports will be investigated promptly

10. Limitation of Liability

Our total liability for any claims related to the Service shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Auction Pro, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
12. Termination
12.1 Termination by User
You may terminate your account at any time by contacting customer support. Outstanding obligations remain in effect after termination.
12.2 Termination by Auction Pro
We may suspend or terminate accounts for violations of these Terms, suspicious activities, or legal requirements. We will provide reasonable notice except in cases of serious misconduct.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of Benin. Any disputes arising from these Terms or the Service shall be resolved through:
- Good faith negotiation between the parties
- Mediation through a mutually agreed mediator
- Binding arbitration if mediation fails
- Courts of competent jurisdiction in Benin as a last resort
14. Changes to Terms
We may update these Terms from time to time to reflect changes in our services, technology, or legal requirements. We will notify users of material changes at least 30 days before they take effect through email or platform notifications.
